Judgment was reserved in the case beard in the Carterton Magistrate's Court, in which J. H. Kelliher, of Carterton, claimed £B5 on a guarantee from C. M'Donald, late of Eketahuna, and now of Rotorua. The dispute arose over the purchase of eight dairy cows, the sale of which was alleged to have been made on a guarantee. As five of the cows did not ■burn out 'to yep rosea tatjons, tne claim was based on the value of the cows at tho time of replacement, whereas iti was contended that tho agreement was to make up the difference between the price paid and that realised from the sale of rejects. The cows were sold to Kelliher at £l2 10s„ and PM®** by plaintiff with the guarantee of £l6, and Kelliher had since made up th© loss to his puroheaer.
