MOTION FOR NEW TRIAL

Judgment was given in the Supreme Court on Saturday morning by His Honour Mr Justice Ilosking in respect to a motion for a new trial and stay of execution of judgment in the case of Quinn V. Catchpole, heard at New Plymouth last month. The original action arose out of a land deal, the plaintiff claiming damages on the ground that the defendant had misrepresented the stockcarrying capacity of the. land. The jury found for the plaintiff and awarded him ,£lOBO. The defendant moved for a new trial on several grounds, the principal tleing that the verdict was against the weight of evidence, and that the jury had been misdirected. His- Honour, in a lengthy judgment, in which the facts were closely reviewed, decided against the defendant and dismissed the motion, the plaintiff being allowed .£l5 15s costs. Mr. T. Young appeared for plaintiff and Mn A. Blair for defendant.
