A JUDGE'S RULING AS TO APPEAL. Br Telecraoh—Press Association. Napier, November' M. Mr. Justice Salmond, at the Supremo Court to-day. delivered reserved judgmcnt in the Wellington case Aitken and others v. Smedley, tin appeal against the refusal of n Magistrate to eject n tenant. His Honour said the first, question was whether there was a right of appeal from the' Magistrate's Court on ejectment proceedings, »nd this had never been the subject, of considered and authoritative determination. "I am of opinion that there is no appeal from the refusal of a Magistrate to make an ejectment order, and if thcreis_ any appeal nt all in ejectment cases it is limited to an appeal by the tenant against an order of ejectment." The appellant also appealed against the. Magistrate's refusal to give judgment for the full 'amount of rent claimed, on the ground that lh» rent agreed upon and claimed exceeded the standard rent of the premises as defined by the War Legislation Act. 1916 His no'nour allowed this part of the appeal.
