That supplying n false name and address to a constable when charged with a breach of the city by-laws is no or"jnce, was rulca by Mr. Day S.M., In tho Magistrate's Court. The case wan ono fn which, a man was prosecuted for cycling without n light. Tho police gave evidence that the defendant, wnen nccosted by a constable, had given him a false name and address. Tho Magistrate held that (he City Council was not invested with power under the Municipal Corporations Act to malto a provision for it to be an offence to supply a false name and address. The charge was accordingly dismissed. The case has been referred to tho City Solicitor with a view to the council taking steps to have th« judgment tested in tho Supremo Court.
