MANSLAUGHTER CHARGE
A RETRIAL IN AUCKLAND. By Telegraph—Pre" Association. Auckland, July 1. The retrial of Alfred Thomas Percy Dare, on a charge of having .committed manslaughter by kiV-ing A. J. Horton at Penrose on January 26, .was' tommcnceu ( in the Supremo Court to-day. It was alleged'that accused was'the driver of a mobor-wir that collided with 'the bicycle riddon by Horton, who sustained fatal injuries. . ... The evidence was, in the main, tho Kime as that given in the previous trial. Dr. Beattie stated that;he saw accused at the request of the Crown Prosecutor on June U to examine him in regard to alleged shell shock. ' Counsel for accused, here objected to the evidence of Dr. Beattie being admitted. -3 The Judgo said he would admit evidence as to the result of the doctor's examino.tion. , The witness then said that ho came to the conclusion that accused was normal, both mentally and physically. llis Honour said ho thought this was as for as witness should go. He was only entitled to give further evidence that was. not in reply to questions put by .hip to accused. The evidence was subject to counsel's objection. . ' . Witness, in further evidence, ma. accused had told him ho ; had run into a man on a Tjicycle. Crow-examined, witness said he questioned accused to test his mental condition. Accused would not know in whose interest lie was' acting. Tho Court adjourned for the day.
