COURT OF APPEAL
A CONVICTION CONFIRMED. Tho:Appeal Conrt was engaged yesterday, in hearing argument on a lcgral point involved in the case of H.M. tlie Kinff v. Gilbert li&ngrion. and stated by Ifis Honour .Mr. Justice Cooper. On the Bench were the Chief Justice (Sir Robert Stout), Mr. Justice Edwards, Mr. Justice Coopev, Mr. Justieo Chapman, and Mr. Justice-Hevdman. Mr. J. Prcndovillo (of the Grown Law Office) appeared for the Grown and Mr 0 J. Hodge (of Tc I'liko) appeared for tlio resnondent. The facts were that Gilbert Lnnpdnn wan tried before Mr. Justice Cooper at Hamilton in March for nn oficnce ngain.it a snrl of the age of 15 years and 11) months. The prisoner was tried twice in 1910 at Hauntton, and at each of the trials t-licv .-uries disagreed. In March of this sear, at t.ho third trial, ncouscd was found cuilty. He was a farmer, end a married man. ■The girl entered the service of tho prisoner in April, 1316, and continued in his service until February. 1919 Tho oflcnco took place on' November 10. 19111, and at the trial counsel for the Crnwn called evidence ob to what took place after November 10. Prisoner's counsel objected to this, and tho opinion of the Appeal Court was sought on tlio question "Whether tho evidence of the prisoner's conduct with the girl niter November 10 was admissible?" After hearing argument the. Court held thai the conviction mii«t stand, and that the evidence objected to was admissiblo.
