MINOR POLICE CASES

■A Before Mr. E. Page, S.M., at tho Magistrate's Court yesterday, Reginald William Norman and Gerald John Dalley were both .remanded to appear on April 29 to ■ answer a charge of stealing a portmanteau and contentß, valued at £5, the property of ono L'entfdr. For insobriety John Killeen was fined 10b., and two firßt offenders were fined ss. each. CIVIL ACTIONS. Reserved decision was delivered by Mr. W, Q. Riddell, S.M., in the caße in which D. Hardie'claimed to recover from Frederick Land the return of £50 deposit paid in connection with tho prospective purchase of tho Tosca photographic, business from the defendant. On paying tho deposit plaintiff -was given a receipt which stated that tho sale was . subject to a satisfactory agreement being drawn up, and signed by the parties. After examining defendant's books -plaintiff decided not to proceed wth tho purchase, and informed defendant of this, consequently no agreement was ever drawn up. Plaintiff therefore sought to recover the return of tho £60. By way of establishing his right to retain the £50, defendant produced the receipt, but His Worship held that that document was not sufficient to prove defendant's title to the money. There was no specific performance by the plaintiff for the purchase of the business.. Judgment -would be for the plaintiff for tha amount claimed, ..with costs £5. ! •At the hearing Mr. 0. R. Beero appeared for the. plaintiff, and Mr. W. L. Rothenberg for the defendant. Thomas William Simmonds proceeded against Mrs. li.. Finch claiming the return of certain household chattels, or their value (a matter of £12), The defence was that the plaintiff had given the goods to the defendant, and merely because of a. disagreement was endeavouring to obtain possession again. In giving judgment for the defendant, Mr. Pago, S.M., said he was convinced that the goods had been handed over as stated by. defendant. Mr. 0. R. Beere appeared for the plaintiff, and Mr. W. G. Mellißh for the defendant. : In a judgment summons case G. H. Price ■was. ordered to pay W. Wiggins, Ltd., the sum of £2 by May, or go to gaol for 48 hours. In a defended case judgment was given for Florence May Paulsen for £4 2s.'6d. and Us, costs, against Paul Stanhope.
