PUBLIC I! OA J) Oil PRIVATE •PROPERTY? Tho Appeal Court was engaged yesterday in bearing the case of William Henry Reid (appollant) and tho Wai■jtotara County Council (respondent),; an appeal from a judgment delivered M>y His Honour Sir. Justice Edivnrds, in tho Supreme Court at Wanganui.

On the bench worn the Chief Justice (Sir Robert Stout), Mr. Justice Cooper, and Mr. Justice Chapman. ■

Mr. A. Gray, K.C. (with him Mr. T. Noave) appeared for the appellant, and Mr. C. C. Ilutton, of Wanganui, represented the County Council. In the Supremo Court at Wanganui tho Waitotara County Council claimed that Reid had for somo considerable time wrongfully obstructed a public road, and when requested had rofused to remove tho obstruction. Reid's defenco was that the alleged public road was his property. Mr. 1 Justice Edwards gave judgment for the County Council, and ordered the removal of the obstruction. It was against this decision that Reid appealed. The hearing of argument had not concluded when the Court rose.
