M'Ginly, a clnim for damages for lir.Mcli of agreement in connection with tlio lease of racehorses. Muclv intcest: was taken in Ihn ca?e. Mr. G. H. Weston appeared for tlio plaintiff, and i\lr. A. If. .Tolr'slone, of Auckland, for the defendant. Tlio claim was for .C 10,53 for an allied breach of conlrncl: in rcspecl of the lease of the horses Staccato and Haversack. M'flinly leased the. two horses, and claimed that during the period of Hie lease both licses became, Inmo and unfit for work, and Staccato eventually died. For lliis reason lie relumed tlio oilier horse l<i Laurent, who refused to (alto delivery, and claimed that the original |ermn of contract bo carried out. The jury found for defendant.
