A MINER'S DEATH
MANAGER FINED. Br TolewaDh—Preiw Annotation. Dunedin, December 3. In the Police Court to-day, David M'Neill was charged with failing to withdraw Robert William Smith from an unsafe place in the Brighton coal mine. Mr. MacGregor, K.C., who prosccuted, Baid that the defendant was the manager of the mine, and Smith was killed by a fall of stuff. Defendant, at 7-55 a.m. on the day of tlio accident, examined tho fall whore Smith was working and found it safe. At 2 p.m. he again visited the place and heard a sound which indicated looseness. Defendant told deceased to take down the stuff. Oil his return at 3.5 p.m. he found this had not been done and told Smith emphatically to take it down. Tho fall took place almost immediately afterwards, and Smith was killed. Defendant's counsel argued that tho instructions given were reasonable. The Magistrate said defendant, should have withdrawn Smith. Defendant was fined X 5 and costs.
