MAGISTRATE'S COURT
ALLEGED ASSAULT
AN UNFORTUNATE SAILOR A man. named Gilbert' Pollock was remanded by Mr. E. Page, S.M., at the Magistrate's Court yesterday on a chargo of assaulting John Shine. Inspector M'llvcney stated that the victim of the assault was an unfortunato man who had previously been assaulted, and was suffering from a broken arm. It was alleged that tho accused caught hold of Shine's other arm and twisted' it severely, causing injuries to tho muscles and joints. Shino was removed to the hospital, where it took some time to nut the arm in order. Shino would not be able to appear for some days, and a. remand till November 5 was requested. The nwused, who was also charged with drunkenness, was remanded till November 5. and on tho application of his counsel. Mr. C. A. L. Treadwell, was allowed bail in the sum of ;£IOO.
OTHER CASES. Alan Henteche, a boy aged sixteen years, and an absconder from Bnrahani Industrial School, was remanded till November 5 on a charge of theft of a watch and chain and a pendant valued at £& os.. the property of William John Braid.
Charges of being a vogue and a vagabond, of drunkenness, and of a broach of his urohibition order were preferred aeainst .Tolui William Campbell. Inspector M'llvcney said that Campbell had a record of twenty-six previous convictions, mostly of a criminal nature. Whilst in England the accused had escaped from hospital and imposed upon many people till he was arrested and sentenced to two months' imprisonment as a rogue and a vagabond. Since his return to Wellington he had imposed upon several persons who held influential positions. The War Belief Association could not do anything for tho accused owing to his drunken habits. Campbell had asked to be sent to Koto Boa. His Worship sent tho defendant to Eoto Boa. for twelve months on tho charge of drunkenness, and on the charge of vagrancy entered a conviction nnd ordered him to come up for sentence if called upon within two years. Vineil JC'2 for drunkenness, George Savillc. an old offender, was fined for a breach of his prohibition order, and was warned that if ho appeared again he would be sent to Roto Boa. Jean AVhitelaw, who was charged with drunkenness, was convicted, and ordered to come up for sentence when called nnoii within twelve months, on condition that she remained at the Mount MnKdala Home during that period. Wlon Wallace was fined 20s. for a like offence. nyiLBPsTNEss DAMAGES TO A MOTOR-CAR. ■Further hearing took place before Mr. W. 04. Eiddoll, S.M., in the caso in which James Leach, taxi-proprietor, proceeded against William' Hnvffreavw, claiming ,£157 12s. 3d. damages in respect of a motor collision between the lorry of the defendant land the Juotor-car of tho plaintiff. Kvidcnco was called for the defenceto rebut the allegations that tho collision was due to the negligent driving of the defendant. Mr. E. M. Boechey appeared for tho plaintiff, Mr. 0. B. Beerc for the defendant, and Mr. J. J. ■ M'Grath for Charles Daniel 'ILwgroaves, father of William Hnrgreaves, who was joined as a co-defendant. The caso was further adjourned till Saturday morning when legal argument will bo heard.
TENEMENT CASE, i Before Mr. D. G. A. Cooper, S.M., H. G. Richardson, a returned soldier, apiilied for an order for the possession of two rooms, at present occupied by Mr. and Mrs. ,T. Everteigh, in a house purebred bv him under the. advances to soldiers' scheme. Plaintiff's father had been turned 1 out of his home in Adelaide Road and the son purchased the house in ouestion, and then, with his father, brothers, and sisters, all of whom are adults, moved into occupation of live rooms of the house he had purchased. The defendant Jessie Evorleigh and her husband had occupied two of the rooms as sub-tenants prior to the purchase by Richardson and remained in possession, ami-paid rent after the new owners moved in. Tho plaintiff admitted that he did not want the rooms for his own use, and the Magistrate refused to make the order applied for. , JUDGMENT~BY. DEFAULT. ■ JUDGMENT SUMMONS. H. T. Barnes was ordered to pay Flan and Conn the sum of .£l3 ss. by November 13. or go to gaol for a week. If Thomas Smith fails to pay the Wellington Drivers' Union the sum of ~E2 15s. 80. bv November 13 he will render himself liable to forty-eight hours' imprisonment. Jlobert Strang must pay J. E. ,I'itzgerald the sum of JE9 3s. Bd. by the same date or go to gaol tor seven days.
BREACHES OF AWARDS. On the information of Mr. E. T. Bailey, Inspector of Awards, B. 0. Englund. licensee of tho Britannia Hotel, was fined .62 for failing to permit two barmaids to have a half-holiday from 1 B.m. on one of.the working days of tho week. Mr. H. F. O'Leaiy, who appeared for. tho defendant, admitted the breach. Miss I!. O'Brien and Miss R. Qualter, employees of Engtund, were each fined 10s. for failing to claim a half-holiday. Mr. H. F. O'Le-ary represented tho defendants, and admitted the breach of the awaro:.
