A. CLAIM SUSTAINED. Before Mr. AV. .G. Kiddell, ' S.M., Thomas liapson and Robert Irving, iormorly trading us .liapson and Irvine,'cap manufacturers, processed against Hymen Samuel Abel and Coleman Hyanen, carrying oil business as Abel and Pickering, AViilis Street, on a claim for sl'47 10s., which it was alleged the defendants agreed to pay plaintiffs for certain material ami fittings supplied when the defendants took over plaintiff's factory. Defendants said they understood the goods in the rooms were saleable, but on examination it was discovered that smno of the material was not up to expectations. ; .ludgmejit was given for plaintiffs for the 'amount: claimed, v • Mr.'W.'Perry appeared for plaintiffs, and Mr. P, W. Jackson for defendants. SALE OF A'JIILK-HOUND. Arising out of the sale of a milk nJuiid, William Ashley, dairyman, of Miramar, sued Sidney Thomas Pritehurd for the recovery of 13=. td. Plaintiff stated that the following sumo were due to liirn: —An instalment of Olio, due under an agreement as purchase money; £2 storage for miik cans, cart, harness, and chaff for eight weeks from the date the. defendant ceased to supply the plaintiff with milkj 13s. for rent of ft graz'.ng paddock; and 10s. for damage for the alleged wrongful interference by the defendant with the plaintiff's use and occupation of certain premises let by tho defendant to the plaintiff. Plaintiff credited defendant with «£3 10s., being fivo weeks' rent claimed by the defendant. Defendant counter-claimed for £5 2s. Cd., being .£1 10s. for three milk cans, and 12s. M., Wis value of fifteen racks. Mr. 0. C. Mazengarb appeared for tlio plaintiff, and Mr. Douglas Jackson for the defendant. , After hearing the evidence, Mr. Huldell gave judgment for plaintiff for .£l3, including .£7 paid into Court, on the claim, together with £i Is. costs, and for the defendant for .£3, and »£1 7s. costs, on tho counter-claim. LOST IN. THE SHIFT. The New Zealand Express Company, for'whom Mr. 11. 15. Anderson'appeared, sued A. Ct. Watt, an officer in tho Lands and Survey Department, represented by Mr. AV. Perry, for tho recovery of .£0 lis. 3d. for tlie cartage of furniture and effects from Austin Street to Minimal - . - Defendant did s not dispute tho claim, lint counter-claimed for .£5, being tho value of an overcoat which he said was lost in the shift. Judgment was entered against defendant on the claim, and on Che counterclaim lie wis .nonsuited, there being no proof that plaintiffs were responsible for Ilio loss of the overcoat. ItUI'GMFNT SUMMONSES. On judgment summonses, Josephine Wilson was ordered to pay .1. E. Fitzgerald, Ltd., .£ll 15s. (id. by November 11, in default-seven days' imprisonment; Tom Kollcber was ordered to pay J. Houston the sum of ,£2 9s. ltld, by the
same date, or go to gaol for 48 hours; and John M'Coll was ordered to pay tho Wellington Drivers' Union ,£1 4s. by November 11, in default 21 hours detention.
