RECENT LITIGATION

In tho Supreme Court yesterday afternoon, His Honour Mr. Justice Hoiking delivered reserved judgment in an action which was beau! .some time ago at Auckland, and adjourned to Wellington for argument. The plaintiff in the action was Georg<> William Minter, of Wellington, for whom Mi. A. W. Bfair appeared, and tho defendant was Percy Arthur Hadley, of Auckland, company manager, who was represented by Mr. M. Myers. The plaintiff claimed .£IOOO in Tespect to which a prom'ssory note, due May 19, IMS, lia<i been dishonoured.. The plainfc.lr contended that the advance; of .£IOOO had beon made by him on the uiklm> standing that defendant utilised the money in connection with an oil-boring contract, ami he further alleged that the defendant never entered into this conti.net, and that the whole basis on which the advance had been made had gomr. Tho defendant, in his statement of defence, alleged that hp was entitled to retain the money until he had obtained the contact, and that nothing was payable except out of the. contract moneys after the contact had been obtained. Defendant, d'.sa counter-claimed for the sum of ,C2!ofi 7s. 2d., alleged to he due for tlio balance of niiTchafe money in connection with certain shares in an option the liability for which had beon urdeiiaken by plaintiff.

His Honour decided that neither the. ckvni nor counterclaim coiild succeed, as action had liwn commenced too noon in both cRRrs.
