CHAIM FOR WRONGFUL DISMISSAL
A DAIRY FACTORY CASE. Rr Talearfcuh—Prma XoinoUtloD Hawera, October 10. A case of consiclerablo interest was bcguii to-day in tho Magistrate's Court before Mr. W. Wilson, S.M., wherein Alfred "William Osborne, factory manager, claimed .£209 damages from the Meremero Dairy Company for alleged wrongful dismissal. The factory was closed down at the end of May, and tlio plaintiff continued as manager until Juno 11, when ho was called before the directors' meeting and notified, that ho would be engaged for another season. Plaintiff continued as manager during tlio off season, but on July 11 revived a letter from tlio directors that they were very dissatisfied with his management and stipulating new terms and conditions, failing complianeo wherewith tho engagement would terminate. Plaintiff did not sign the document, and replied with a spirited letter on August 1-1. The chairman of directors thereupon wrote to'tho plaintiff handing him a cheque for a, month's salary in lieu of notice, and also the amount of wages from August 1 to 14. Plaintiff's counsel said that his client had been nualilo to securo another factory engagement this season, and contended that his refusal to sign was not sufiicicnt ground for dismissal. The cross-examination of tho plaintiff was not concluded when the Court adjourned.
