RATES ON WATERWORKS
JOHNSONVILLE TOWN BOARD TO PAY. At the i Magistrate's - Court yesterday reserved judgment was delivered by Mr. W. l G. Riddell, S.M., in the civil action Citv Corporation v., the Johnsonville Town Board—a. claim for .£l7 19s. 7(1. for rateiS on waterworks owned bv tho Town Board and situated in the city area. .The action followed on the amalgamation of the borough' of Onslow with the citv. The Borough Council had water-works-in ,tne Johnsonville Town Board district, and the board also had waterworks in the borough area. Early this vear the Town Board took proceedings against, the borough for the recovery of rates on the waterworks, but this action failed, for the reason', that a borough council was exempted from such rates. As a result of this action the Onslow Borough Council ascertained that a to-.vn l>oard was not so exempted, and on the dav Drier.to. tho eoMiwl'a amalgamation with the city, proceedings were instituted against the 'Johnscnville Town Board for rates in respect of the waterworks owned bv that board and situated in Onslow. Tho city corporation proceeded with the action after the amnlgainatfon.
After reviewing the legal arguments raised. His Worship, said that the defendants could not succeed unless it was nroved that the term "borough council" in section 2, paragraph .ft), of tho Rating Aot included a "town board."
Judgment would, lw for the plaintiff corporation for the amount claimed and costs M lCs.
At ths hearing Mr. J. O'Sliea (City Solicitor) appeared for the plaintiff corporation and Mr. D. .Jackson for the defendant board.'
