In doing so ho said that no proposed to ask members and guarantors of tho club to take up MO debentures, interest to bo paid at the nito of U per cent, per annum. This would enable them not wily to reliovo 17 bank guarantors but lieu to raise a largo sum of money to carry out other schemes. • it was decided to leave the matter in the hands of tho committee to bring up a report. A new buffet in connection with the Palmerston North Young Men's Christian Association was opined yesterday morning in tho buildings of the Mauawatu Racing Club in lUngitikei Street. The premises are, admirably suited for re-(j-airenieiita, being both spacious and airy. They havo been comfortably furnished, tho front portion being litted up as., a lounge and smoking room, with writing desks along ono wall. A back room is fitted up as a, most complete buffet. AVord has been received that at Los Angeles, on the Ascot Speedway, tho Palmorston rider Percy Coleman managed to win sixth place in a 200-mile contest, although riding an unfamiliitr maohine on a now course.

At Palnierston tho Linton Rifle Club held the final of the miniature riilo championship this week, when the championship,' in which all fired from scratch, was won by J. Griffiths. The following aro the scores: J. Griffiths,.336; S. Tremaine, 335; AV. Mum'o, 333; T. Edwards, 333; G. Noivth, 329;' W. Ball, 323; \\. Vincent, 327; J. Marshall, 327; T. Inglis, 324; G. Treuuune, 312; 0. Page, 327. In the handicap competition W, Munro and T. Edwards (with a handicap of 3 each) tied with 33G points. In the shoot-off they again tied with 31 oaeh, but in again trying > conclusions My. Munro scored 35 to his opponent's 34 and iron the match. Anotuer match will bo commenced on Monday evening next.

A reserved judgment of interest to stock, owners was delivered in the Palmerston North Magistrate's Court yesterday by Mr. ,T. L. Stout, S.M., in a civil action John Kearins v. John P.obertson, a claim for J59 Bs. In July Inst, plaintiff said, ho offered 35 fat ewes for solo at Dalgoty's yard, and they were bought by defendant for 3Bs. Cd. each. Plaintiff: discovered that defendant refused to take delivery of the sheep, and notice was sent to him that they would be sold again and lie would be charged with the difference in price obtained. They wore accordingly sold and brought 325. 6d. each, tho fees charged' being i; 2 Bs. Plaintiff admitted that lie told the auctioneer-that, they ■ ivero fat ewes supposed to be empty.' The ease for the defendant wa-s 'that the sheep were bought for 1311101101-8' sheep, and that on being found they were in lamb defendant refused to take delivery of them because they wore not according to tho description under which they were sold. In his judgment His Worship pointed out that there was no guarantee that the sheep were empty, but he thought purchasers were entitled to draw the inference from the auctioneer's description of sheep that they were being sold as fat ompty ewes. The purchaser had no opportunity of making an individual examination o'f the sheep, and the evidence Wore him was that it was impossible without such 'examination or upon mere casual examination of tho sheep iii the pen to tell whether they were ompty or not. In His AVorship's opinion, therefore, tho sheep were sold under the description of "fat empty ewes"; on examination. tlioy ivere found not to fit this description; the purchaser was entitled to an opportunity of such examination before he accepted delivery. It ivas not a case of warranty, but in his opinion a easo of salo by description, and the purchased' was entitled to refuse to accegfc them as not being according to description. Judgment would therefore be entered for defendant with costs.
