A case arising out of the train smash pear the Heathcote bridge was heard in the Supreme Court, Andrew Clark, a foreman carpenter, claiming .£5Ol damages from tho Tramway' Board for iniuries received. Tho plaintiff stated that he suffered bruises on tho 'body and injury to the spine and nervous system, and still was incapacitated from work. Ho was suffering, and was ilikely to suffer for some time to come, from tho effect of shock and from nervous disorders.

The 'board paid ,£2OO into court, and did not file a defence, counsd submitting that the only question to 'be decided was whethor the was sufficient.

The jury awarded plaintiff .£375 and costs.
