In the Magistrate's Court' to-day the owners sued a tenant for possession of a property of Si acres at St.' Martin s.* One of the owners said he had sold the property and had given the defendant notice to quit as from June 1. Efforts had been made to obtain another house for the defendant. The delay in obtaining possession had been a great inconvenience and no little loss to him. Counsel for the defendant submitted that the' -property occupied by the defendant came under the definition of dwelling-house, and that the land was an accessory to it. The defendant had seven voung children, and found it very difficult to find another louse suitable for their occupation. _ . , , , The defendant said his wife hnd been born in the house, and they had lived there a very long time. He had applied to every house and land agent in Cliristchurcli, and had been unable to get another suitable dwelling. The plaintiff was granted an order for possession within seven days.
