DEFINITION OF "EVENING"
© APPEAL'BY LABOUR DEPARTMENT. Br TeleeraDh-Press Association. Christchurch, May H. An important question that affecta many employers and employees in New. Zealand, also the interpretation clauses in many legal documents, came before Mr. Justice Herdman in Banco rnis morning. An appeal was made by the Labour Department against the decision of Mr. Day, Stipendiary Magistrate at Timaru, interpreting the meaning of the word "evening" in section 25 of tho Shops and Offices Act. In a case in Wellington the Chief Justice ruled that evening means "after limo cf sr-nset." Later, the War Regulations Act interpreted evening as "the time of day not earlier than 5 o'clock in the afternoon." The Department took action against a Timaru firm for keeping premises open after 7 o'clock. Mr. Day dismissed tho case on the grounds that the interpretation in the War Regulations Act does not override the Chief Justice's decision. After hearing argument His Honour icserved judgment.
