Mr. Justice Chapman, in opening the Supreme' Court 'sessions at Palmerston North to-day, congratulated the grand jury 'on the. general absence ,of crime in the district. Robert Edward Brassell was arraigned on an indictment charging him with committing theft of ,£9O from the person of Isaac Pearson at Palmerston North on' April 5. Accused was defended by Mr. Gilford Moore, and pleaded not guilty. l The evidence went to show that tho complainant Pearson arrived in Palmerston North in April from Seddon with <£100 iri his possession, in two notes. Hd cashed a .£SO note, and received in change two .£2O notes and smaller change. 1(6 placed all the'notes in Jiis possession in' his hip pocket. ' He afterwards went to the Central Hotel and met the accused They had some drinks together, ami an cused suggested having a walk. They went to another hotel and had drinks, and Pearson left by himself. Accused followed, him about the streets for _ some time till Peuraon fell down. While he was on. 1 the ground lie felt the accused put his hand in his'hip pocket and ex. tract the money. Accused then made oft. He complained to" the police, who arrested the accused, who denied any knowledge of the theft. On being searched ho was found to have concealed on his person a .£SO note and two .£2O notes. Accused did not give evidenco, and did not call any witnesses, The jury, after a short retirement, brought in a verdict of guilty. . His Honour imposed a sentence .of fifteen months' hard labour, and said lie would make .representations to' tne''Justice Department in relation to the stilto of tlie'prisoner's-health, which, according to the'evidence funiisheu by tho police, was very precarious. It was' suggested by counsel that Brits, sell' should be sent to the prison treeplanting camp " An ordor was made for tlie restitution of tlie money. ■ The Court tliou adjourned till tomorrow.
