MAGISTRATE'S COURT
BOARDINGHOUSE AFFRAY STABBED WITH A KNIFE The sequel to a fracas which occurred in a boardinghouso on or About Juno 2li last was heard before Mr. F. V. Frazer, S.M., at tlio Magistrate's Court yesterday, when Thomas Mickey, labourer, of Wellington, for whom Mr. J. Scott appeared, proceeded against Andrew Anderson, a labourer, on a claim for ,£l2O ss. damages. The action was not contested. Plaintiff stated that ho was sitting at his tea on tlio night in question, when Andorson began to argue with him. Witness declared that ho did not want to became embroiled with defendant,, but the latter continued to bo aggressive and finally stabbed witness in the shoulder with a knife. Anderson was arrested and sentenced by the Supremo Court to 18 months' imprisonment, but he had sinco been released. Plaintiff said that as a result of the injury he received his earning capacity had fallen considerably during the past ten months, his average earnings having gone down from £2 or ,£1 per week to something under .£'2 He was pretty well right again, but still suffered from an occasional pain in the shoulder. His claim of .£l2O ss. was made up as follows Special damages, loss of four weeks' wages, J;15; medical expenses, J.'s 55.; general damages,. ,£IOO. His Worship reduced the general damages to £75, and gave judgment for plaintiff for £% ss. KENT OF A HOUSE. Mrs. Charlotte Trcadv?ell. for whom Mr. J. l'l. Morrison appeared, sued Rowland Thompson, clerk, represented by Mr. H.' F. O'Leary, for £U liis. lOd, being balanco of rfcnt alleged to be due for a furnished house, together with cost of certain breakages alleged to have occurred to some of the contents of the house. Defendant paid' into Court £i which he admitted ho owed, but counter-claimed for .EG 10s. for rebate of rent which lie asserted 'the plaintiff agreed to give if lie remained in the premises for twelve months. . ■ . After bearing evidence, His Worship gavo judgment for plaintiff for 10s over and abovo the amount paid into Court. I'hoinpson was nonsuited on the counter- j claim. CLAIM FOE BOARD. Before Mr. F. V. Frazcr, S.M., Ada Heani sued Richard Cargill for Jill lis. 8(i„ being balanco of board alleged to bo due on behalf of defendant and lus sister, together with cost of goods purchased for defendant and money stated to have been lent to him. . Mr. J. A. Scott appeared for plaintiff, and Mr. E. M. Beechey for defendant' After hearing evidence, His Worship gave judgjuent for plaintiff for .£lO, with Bs. costs. . / UNDEFENDED CASES. Wheeler, =£13 55., costs i! 2 os. Gd. POLICE" CASES. The police cases wero heard by Mr. F V. Frazer, S.M. 'Maud Grant was fined in default seven days' detention,, for a breach of a prohibition order, and waa convicted and discharged for drunkenness. Euiily Baker and Thomas Cross wero each sentenced t0,14 days' imprisonment for having committed a grossly indecent act in College (Street. Two first-offenders for insobriety were fined 10s. each, and two others ss. each. Ernest Georgo Broderick was fined £1, with costs ,£1 Is., for having made use of obscene language. A steward named George Green pleaded guilty to stealing two tins of salmon and two tins of herrings, valued at Gs., from the sailing-ship Edward May, and George Ryan, a nightwatchman, admitted having received the goods, knowing them to havo been dishonestly, obtained. It appeared that Eyan suggested that Green should get him some iish, as he wanted it for a sick person. Green accordingly took the tins from the ship's stores and gave them to Eyan. His Warship considered that liyun was tlio worst offender ,of the two, as in reality it turned out that he wanted tho fish fov himself. was fined .£3, in default 14 days' imprisonment, and Ryan was fined io, with the alternative of a month's imprisonment. In the •afternoon Mr. D. G. A. Cooper, S M„ heard several cases.
An American seaman named Karl Johannsen was charged with having deported from the schooner Else oil April •1. Defendant was convicted and ordered to 1)b handed over to the United States Consul under section 311 of the Shipping and Seamen Aet. For failing to have lights on vehicles, Frederick Connoly was fined 10s., with 75.. costs,, and JVilliain Peatheram 55., with 7s. costs. Frederick Bell was fined 10s., with 7s. costs, for having driven a motor-car without possessing a license. Alexander Thomas M'Williams was fined 55., with T.r. costs, for permitting a horse to wander. On an information of failing to have a light on a heap of gravel in Hamilton Road, Kilbirnie. Irederbk Hulse was fined 10s., with costs 7s.
