LICENSEE WINS AN APPEAL CASE. By Telegraph-Press Association. Timaru, February 7. lii. the Supreme Court to-day Mr. Justice Sim gave judgment for 'the appellant in the rase Kenning (licensee of the Club Hotel) v. the Police, an appeal from a Magistrate's' conviction for selling liquor in licensed premises during closed hours. Appellant's barman sold liquor before 9 a.m. It was contended that the appellant was not liable, as her instructions to the barman were to refuse any sale before (he legal opening hour. His Honour held that the barman was in the bra- only to clean it, and sold the liquor contrary to the licensee's expressed wish. The licensee, therefore, vrns not responsible for' the sale, and the conviction was quashed,
