In the Magistrate's Court at Martinborough this week J. E. Baisen, carrier, was charged by the Ifeatherston County Council with allowing n motor lorry to be driven on the Jvahautara Hoa'd in contravention of the heavy traffic by-laws. Counsel for defendant stated that it was desired to test the by-law, as to its unreasonableness, in that his client was employed by the mill-owners on contract to carry their timber, which iras essential to industry, and used for the manufacture of hiitter-boxes, cheese crates, etc. Several legal points of objection were quoted to prove the by-law was partial and unequal in its operation, harassing, and oppressive, and unlawfully restricting the trade—the effect being that for live months of the year the mills cannot transport their output. The Magistrate said he would take time to consider the legal point raised.
