'TROUBLE IN GARRETT STREET.
..The proceedings -at the Magistrate's Court yesterday woro presided over by Sir. F. V. Franer, S.M. A-t 5 p.m. 011 Saturday last Gaol Warder Burberry noticed ;a . man named Robert Turnbiill behaving in a threatening manner in Garrett Street. Turnbiill was (irraigned on, a chargc of threatening, behaviour, and hu was .also acci/'fied of assaulting a soldier whoso name at present is unknown. He lulniitled the first charge, but denied the assault. The police evidence showed, that tlio accusod had assaulted somebody, but as the mail iiad been carried away, and not since traced, his identity' could not' be established. Inspector Marsack stated that Turnbiill had been previously convicted' of a 'similar olfsmce nt Luncdin. His Worship derided to treat the two charges as one, as tlio circumstances connected with each were the same. •The police agreed to the withdrawal of the first charge. On the _ charge of assault the accused was convicted and fined ,£!), and vas ordered to pay witnesses' exponses, 10s., in default 14 days' imprisonment. . A plea of guilty v>'as entered by James •Patrick Delaney when charged with assaulting a seaman named Andrew Casey. Police evidenco was to the effect thnt the accused struck Casey during the course of an argument, causing him an injury to his face. Following this, the accused administered first aid to Casey. , His Worship: That' was a good principle to follow. After explaining to the accused that it was an assault to strike a man even if that man were willing to fight, His Worship ordered Delanoy.'to forfeit his bail of 10s. When Ernest Stevens was charged v;ith tlio theft, on December 7, of" a quantity of "motor tools, valued at XI 7s. litl., the property of William May, Inspector Marsack applied for a. Temnnd till December li), as the accused had staled that the tools had been given to him by another man. That statement might or " might not lie true, and it was desired to make certain inquiries. His Worship granted the remand, allowing bail in the sum of .£25 and one surety of J125. On a charge of having, at Woodville on November 18 last, committed forgery by making out a false cheque for illd'lOs'., which purported to be drawn by Jessie Alex tod on the Itank of New Zealand, Dannevirkc, and uttering the same to Frank Martin ICenney, Sydney Mexted was, on the. application of Chief-Defec-tive Uoddam, remanded lo appear at Woodville on December']'). For' insobriety Patrick Cooney was fined 10s., in default 18 hours' detention, and ho was also prohibited. William lirnest liuchanan, . who was found helplessly drunk in Woodward Street, was ordered to pay 17s. (Id.medical expenses, in default 72 'hours' imprisonment. Several first offenders were lightly dealt with. .• • For disobedience of a maintenance order, John Gordon was ordered lo be imprisoned for a month, (ho warrant to be suspended for 'seven days provided nil attempt is made to wipo out (lie arrears, amounting to .(.'2l. Ellen Townshend, for whom Mr. J. J.. M'Grath appeared, asked for an order separating her from her husband, Thomas .lames Townshend, who was represented by Mr. V. AY. Jackson. The Cmirt was also asked to make conditions as to Hie payment of maintenance. The ground of the application was porsilenl: cruelty. His AVor.ship characterised the evidence given in the case as bei*g very contradictory, but he granted the application. Defendant' was ordered to pay maintenance at the rate of lllls. per week, with 2s. costs, and past maintenance amounting to .£7 Ids. was also allowed.
