CLASS C 2 MEN AND THE TERRITORIALS
RECENT JUDGMENT
The following note on recent litigation in respect of territorial service by Class C 2 men appears in District Orders, just published :—
The Supreme Court has reversed the decision of Mr. S. E. Jl'Curthy, S.M., in the mutter , of the rendering of personal service nmlei: the Defence Act, 1909, as teirttorials," by 'men who have been drawn in the ballot and classed C 2. The Supremo Court has held thnt all men have a double-'status by being botli members of the Expeditionary Force and members of the Territorial Force, ami Hint whilst not actually serving in the Expeditionary Force a man is bound to perform his duties in the ordinary course as a member of the Territorial Force. This decision not only affects reservists classified C 2, but will also affects sine die adjournments and nil other decisions affecting the status of a member of the Expeditionary Force who is not actually serving in regard to his services as a member of the Territorial Force. Men of the Territorial Fore; who are members of the Expeditionary Force, and \not' actually serving in Uie Expeditionary Force, ehould-therefore be called upon to render personal services required of them under the Defence Act as members of the Territorial Force.
