At the Wimmera inquiry Mr, M'Veigh in concluding his address, submitted that the charge was one of a serious crime, and. must be supported by. the strongest proof. . , Mr.'"'Myers, counsel for : the Marine Department, in'reply, said the •question of manslaughter was not before the Cou'-t. It was obvious that the cause of the casualty was an' explosion, or two explosions. The theory of internal explosion'was' not supported by tno evidence.' The only conclusion was that tho vessel was struck by ;a moored mine. Route orders issued to Captain Kell in October and January left no. possible misunderstanding. He was warned of the danger in Auckland ai'-H in Sydney. There was no navigation difficulty, and it was obvious that Captain Koll adhered, to. the course he had previously?."taken.';, . ; ■ The Court adjourned- -till'Tnteday.
