O WILLIS STREET LAND

CLAIM BY DUKE BUILDINGS, LTD.

The award of the Compensation Court in tho olaim for compensation mado by the Duko Uuilclings, Ltd., against tho City Corporation was delivered yesterday morning. On the .Bench were His Honour Mr* Justice Hosking, and Mr. G. H. Scales, assessor for the claimants, and Mr. 0. H. Morison, K.C., assessor for tho City Corporation. ; The company claimed .£2530 for a 1011. strip of land in Willis Street taken by the Corporation for street-widening purposes, and £0210 for cost of reconstructing, cost of shifting of tho bar, disturbance of business and injurious affection, making a. total of £11,740. The case occupied five days in the hearing, numerous land agents and experts being called to give evidence. The Corporation having undertaken by its council that the erections on tho land taken should he forthwith removed, and that tho land taken should ho thrown into Willis Street and constituted a footpath, the special claim of £5000 had beeii abandoned. Dealing with tlie balance of the claim, £11,740, the Court, after taking the question of betterment into consideration,-awarded both for land taken and prejudicial affection the sum of £1650 in full settlement of the total claims made, including,any claim that may ba made by tho lessee. Tho claimants' to undertake to indemnify the Corporation against any claims that may bo-made by the lessee, Mr. Dwycr. The assessors werA awarded 60 guineas each, each fide to pay its own ; assessor. His Honour stated that the award was that of a majority of the Court, Mr. Morispn not agreeing to it. . At the hoaring Mr. M. Myers, with him Mr. Gf. Watson, appeared for tho Duke Buildings, Ltd., and Mr. A. Cray, K.C., with him Mr. •{. O'Shea, City Solicitor, for the Corporation.
