ARBITRATION COURT
'CLAIM FOR COMPENSATION. \ Yesterdiiy. afternoon the Arbitration Court, was engaged in hearing a claim for compensation. On (he bench were His Honour Mr. Justice Stringer, Mr. W. Scott (employers' representative), and Mr. J. A. M'Cullough (workers' representative).
James Knight, of Hamilton, carpenter, claimed from George H. Scales, Ltd., shipowners, the sum of for the loss of his son at sea. The plaintiff is the father of William S. Knight, who was an apprentice aboard a barque trading overseas, and on January 19, 101S, while on u voyage from San Francisco to Duneclin, and when about twenty miles off Hanks Peninsula, the lad fell overboard, and was drowned. Tho plaintiff was partially dependant upon the lad, who was within a few days of being sixteen years of ago when lie met his death. Mr. V. J. O'.Regan appeared for the plaintiff, and Mr. A. W. Blair for the defendants.
In.opening, Mr. O'Regan, after giving Hie details, slated that the Court had a right to look into Hie possibilities of the ease. Not ho very long ago in the SonFli .[.-land, His Honour decided a .cane where ii boy of fourteen years of ajje was, with others, drowned at Gre.vmouth. The mother claimed as a partial dependant, and His Honour awarded her MOD because thero was a probability of the lad, had ho lived, being able to help his mother for some years. The corapettsalion to be paid a partial dependant did not depend upon the earnings of the deceased, but as the lad had been contributing the whole of his earnings, it was an inference that he would contribute more as bo earned more. There were anticipatory benefits.
Mr. Blair dealt with the legal Aspect of Hie case at some length, referring specifically to the position of partial dependants, and pointing out that when ilic lad went to sea they werii not depenitent on him, and at the time of his death they had for six months prior thereto received no benefit from him.
As there'was a'question of principle involved, the Court reserved its decision.
