ICE CREAM AND BUTTER-FAT

ALLEGED ADULTERATION. \ Mr. S. E. M'Carthy, S.M., delivered his reserved judgment yesterday afternoon in the Magistrate's • Court in the case in which Johp Henry Cowdrey,' Inspector under the Sale of Food and Drugs Act, proceeded against tfye Marble Bar, Ltd.,. tor selling ice cream alleged to liavo been adulterated, the adulteration consisting in the cream being deficient in butter-fat! The defendant company. bought its milk and cream from the City Milk Supplies, Ltd., and' the agreement contained no warranty as to quality. The contention of the defence was that reliance was placed on the company supplying the milk, and that if the milk and cream obtained had been up to standard 'lie formula used would have givoii ice cream up to the standard. "It is a lflatter of local history in Wellington," continued "the Magistrate, "that milk suppliers have been frequently prosecuted and fined _for selling adulterated products'. He, therefore, who pins his faith to these people trusts in a broken ;eed." The defendant company admitted the deficiency in butter-fat, but. contended that the fault did not lie with them. The defendant was convicted and fined .£lO, with costs 28s. Mr. J. Prendeville, of the Crown Law Office, appeared for tho informant, and Mr. A. W. Blair for the defendant company.
