DR. M'KINNON'S CASE

REGISTRATION REFUSED,

The Full Court gave judgment in the caso ill which John Alexander M'Kinnon, medical practitioner, Christchurch, applied for m\ order to be directed to tho Registrar-General to register him under the Medical Practitioners Act. M'Kinnon, it will bo remembered, was connected with what are known as the Customs frauds, and was tried and acquitted. It was urged on his behalf that tho verdict of the jurv should be accepted by the Court. Had he been convicted that would have been final, and acquittal Should also be accepted as conclusive. It was further urged that "good fame" and "character" as mentioned in tho Act meant reputation, and M'Kinnon was a man of good reputation in his locality. For the Registrar-General it was urged that affidavits filed- charged M'Kinnon with a iong course of theft and fraud and official breaches of trust as an officer of tho Customs Department. Further, that "good fame" and "character" mcaut external reputation merely, and did not relate to tho applicant's character. It was further contended that the charges referred to amounted to justification for refusing registration. The okso was heard by the Chief Jusuce (Sir Robert Stout), Mr. Justice., Chapman, and Mr. Justice Sim. The appeal was dismissed and appellant was ordered to pay .£lO 10s. costs. At tho hearing Sir John Findlay, K.U, with him Mr. Hunter, of Christchurch, appeared for tho appellant, and the Solicitor-General (Mr. J. W. Salmond, K.C.) for tho Registrar-General. -
