A CMISTCHUIiCH CASE. At thn eiMiiii? of the Appeal Court yesterday, a Cliristciiai'uh case, 0. S. Meredith, Wniniate, v. Andrew Frccbairn, tiydney, ciuue u;> lor aigumont. On tl\o Jtcucli were His Honour the Chief Justice (Sir Robert. Stout), His llonuiir Afr. Justice Coupcr, and Jlis Honour Mr. Justice Chapman. Jlr. iJ. .Myers, with him Mr. Hunter, appeared for the appellant company, and AJr.. Ivirkcaldie foi - the respondent, The ujipeil was from a jmlymciit delivered l>y Mr. Justice- Sim in the Supreme Court, in which the appellant!) were the defendants and counter-claim-ants, and respondent was the plaintiff. In that action plaintiff claimed ,£2l'.! 19s. Gil., a balance of-money which they alleged was duo to them us commission on sales of produce, and defendant counterclaimed 1*1037 Ss. Id. for alleged negligence on the part of plaintiff. Mr. Justice Sim decided in favour of I'reebairn on both 1-iiß claim and counter-claim. Notice of appeal against '.his decision as a wholo was given, but by a later notice it was intimated that the appeal would bo limited to that part of the judgment which dealt, with the couuter-clnim. After hearing argument the Court reserved decision.
