SUPREME COURT

A DISPUTED TRADEMARK. An application under section 64 of the Patents, Designs, and Trade Marks Act' was heard in the Supreme Court in Chambers yesterday, before Mr. Justice Stringer.

Tho application had to do with an article of apparel known as "The Boston Garter," and on behalf of the applicants, Mr. C. H. Treadwell asked for an order declaring this to be a distinctive trademark. Mention wasmade of tho fact that under the old. law—the 1908 Act—there was a prohibition of the regiotration of geographical names, but that the present Act allows it where application is made to the Court and aesent is given.

Mr. J. Prendeville, of the Crown Lair . Office, opposed the application on technical grounds, including that of proprietorship. His Honour intimated that ho was almost satisfied that the application came within the section, he would consult the authorities quoted by counsel before giving his decision. If he was satisfied, the only order the Court would make would be declaring „ the term a distinctive mark. After that the Registrar of Patents would, deal with the application in the ordinary way, and he would have to be satisfied that the applicant was the fit and proper person to whom to award the mark

CLAIM FOR COMPENSATION. In tho Supreme Court yesterday judgment was filed by Mr. Justice Stringer in the case of the Public Trustee v. His Majesty the King, in the matter of the Workers' Compensation Act, 1.908. The Public Trustee claimed £260 compensation as administrator of tho estate of Luke Jackson Torreus, labourer, late of Ohakuno. Torrens died on' May 15, 1916, as a result of an accident Buffered whilein the employ of the Public Works Department. Deceased lefy a dependant behind hw, in the person of hia widow. . . . Judgment was given for the plaintiff for £125 with costs £3 3s. .and disbursements.
