TOBACCONISTS' CLOSING HOURS
A NOVEL LAW POINT. In the Magistrate's Court yesterday, before Mr. S. E. M'Carthy,' S.M., a novel defence was raised by Mr. J. J. M'Grath. The case -was that in which Harry Davis, confectioner and dairyman, of Cambridge Terrace, was proceeded against by the Labour Department inspector on two charges of selling cigarettes after hours. The case was brought under the Shops and Offices Act.
The sales were admitted; but Mr. M'Grath contended that the defendant did not come within the limitations contained in the tobacconists requisition. Counsel argued that defendant was a restaurant-keeper and not a tobacconist within the. meaning of the Act. The Magistrate, said ho would look into the point raised before giving his decision.
