— 0INQUIRY TO-BE MADE AS TO . BENNIER'S SANITY,. The Justice Department has received & letter from counsel for the man Ben- . nier, convicted and condemned to death :£or tho.Kauangaroa murder.' Mr. C. E. Mackay, who was advocate for the (prisoner at the trial, has written to tho (Department stating that since the trial jhe has received information from a ' j man of some standing in the Nelson i district, a Justice of the Peace, that ' ! some time ago Bennier was insane. ; Mr. Mackay states that the difficulty ; in the defence of Bennier was that- he 'i i had no good information as to the previous life history of the accused man. '.' -Mr. Mackay suggests in his letter that a /if this evidence which is now offering i ■ had been availabje at the trial it might shave influenced the jury in the verdict. He asks, therefore, that tho matter be ■Investigated before tho fate.of Bennier ■ is finally decided. The investigation will, as is the ini variable practice in such cases, be rr.ade by the Department. .'-.■' . ,
