COURT OF APPEAL
MATSON V. FISHER,
The Court of Appeal sat yesterday morning for the purpose of hearing an •application on behalf of IT. Matson and Co., of Cbristchurch/for leave to appeal to tbe Privy Council. The bench was occupied by the Chief Justice (Sir Robert Stout), Mr. Justice Denniston, and Mr. Justice Chapman. Mr. C. P. Skerrett, K.C., appeared for Matson and Co., and Mr. H. J. Beswick for the other parties, George Fisher and another, in whoso favour the Court of Appeal had decided' tho case. _ .The subject of the appeal was the disallowance of interest by an arbitrator appointed to settle the respective claims of the parties in certain transactions that they had bad. ..Mr. Skerrett. said that ii appeared to be impossible to proceed with the motion for leave, as the amount involved in an appeal to the Privy Counoil would not be over'£soo. The interest'in dispute amounted, in fact, to only!£300. Tho motion was accordingly withdrawn. The Court adjourned till December 10.
