SUBURBAN MOTOR SERVICE
A QUESTION OF LICENSE FEES. ' A case of special interest to the suburban motor-bus services came before Mr. S. E. M'Cnrthy. S.M., in 'the Magistrate's Court yesterday, when Messrs. M.'Ewcn, Carter, and Co., Ltd., proprietors of a motor-bus, were sued l>y the City Council ro recover,a license fee of £25. Mr. ,T. O'Shea appeared for the city authorities and Mr. K. C. Kirk for the defendant company. ' Mr. O'Shea stated that the dofondant company's motor-bus plied for hiro in the city. It was run to Petone from Bowen Street, and was one of a number Of buses carrying from lli to 25 passengers, at « fixed faro of Is. each single nnd Is. 6d. return. It was claimed by-the city that theso motor-buses were stage carriers as defined by the city by-laws, and subject to license. The licorißO fee was .£25 a year, or .£2 2s. per mrmtn. .He put in the city by-laws bearing on Iho point, but called no evidence. Mr. R. C. Kirk, on behalf of the defendants, said that, the decision in this case would affect the whole of the motorluises in the. suburban "Crvice. All the parties concerned considered that there was not the slightest justification for charging a fee of .£2H. The-buses were ■ licensed in their novernl districts, and it was contended that. X 25 was.an.inordinato rtiid extortionate fee. The by-law was 'fixed for quite another-purpose, nnd was not: n reasonable fee in such cases as these. Tie quoted the fee.? charged in other places, which were from .£1 to £2 g per annum. After a partial hearing the case was adjourned to Wednesday.
