MAGISTRATE'S COURT
TEAM CONDUCTOR ASSAULTED. Mr. Ij. G. Koid, S.M., presided at tho Magistrate's Court yesterday. Daniel Donovan, an employee of tho Harlwui" Board, was charged with as-, smiting a-tram conductor named John Alfred Weinberg. The accused pleaded not guilty, and was defended by Air. H. F. U'Leary. According to the evidence ol Conductor, Weinberg the, affair happenud'on a car bound for Kilbirnie on Saturday evening. Tho accused boarded the car in Lamhton Quay, and stood oir tho hack platform, and was asked by the conductor to move inside, but refused io do so. Oil two subsequent occasions accused was asked to go. inside, and eventually did so. When the car reached Coiirt-onay Place accused left • tbo car,. but before doiiig so struck tho conductor on tho face with his open hand, kicked him on tho shin, and toro his uniform. There was absolutely no provocation. Constnblo .Lβ Fevre said tlmt when ho arrested the accused tho tatter said : "Don't you think somo of these heed a- crack? This fellow anuoyed me, and 1 gave him "a crack." The constable added that tho man was in a stitto of "vindictive drunkenness." Defendant denied the assault, but the Magistrate held, that an assaiil), had been committed. It niay .havo boon a trivial affair, but conductors must bo protected. Defendant was fined '205.. and was ordered io pay the expenses entailed upon the conductor.
