A FBUIT CASE. His Honour Mr. Justico Edwards heard an appeal ' by Simon Edilson against a decision of Mr. W. G. Riddoll, S.M., awarding Ivo Sclwyn Joyce £53 12s. 6d. damages for breach of contract. The defence of Edilson in tho Lower Court was that certain instalments of fruit delivered by.. Joyce were not in accordance witu the contract. Edilson therefore refused to tako any further instalments, and Joyce brought the action against Kim. The Magistratq held that Joyce's failure to deliver some instalments in accordance with tho contract did not justify Edilson in cancelling the contract. At the hearing of the appeal yesterday, Mr'''A. Gray, KiC, and Mr. D. R. Hoggard appeared for tho appellant, and Mr. P. H. Putnam for tho respondent. His Honour reserved his decision.
