COURT OF APPEAL

A MOTOR MISHAP APPEAL DISMISSED . Tho Court of Appeal yestorday heard further argument upon tho appeal of Mrs. N. Nightingale, taxi-cab proprietor, against an award of damages mado by tho Chief Justice to Alfred Ernest Cooker. His Honour Sir John Denniston presided, and with him Their Honours Mr. Justice Cooper, Mr. Justice Chapman, and Mr.' Justice Hosking, occupied the Bench. In tho Supremo Court Sir Robert Stout found that the plaintiff Cocker had been injured by a inotor-car which was tho property of tho defendant, and was driven by a servant of the defendant in. the regular course of his employment. His Honour awarded Cocker £180 damages. When the'appeal camo before the Court on Tuesday last, Mr. T. M. Wilford, who appeared on behalf of the appellant, was heard. Yesterday the Court called upon the opposing counsel, Messrs.. J. O'Shea and H. Buddie, to argue the matter. The appeal was dismissed. /
