9 RESERVED DECISIONS. In the Supreme Court on Saturday morning, the Chief Justice (Sir Robert Stout) gave judgment in the case in which Griffiths and Co., Ltd., of Wellington claimed against the Union Steamship Company respecting a cargo of bananas thati was landed in bad condition. Judgment was for the plaintiff for £733, with costs. • In- the case of Alfred Ernest Cocker v. Mrs. N. Nightingale, in which m claim of £698 was mado against tho defendant, a motor owner, judgment was entered for plaintiff for £180. One of defendant's drivers had run plaintiff down, and tho question for His Honour was as to whether the driver was at the time acting in tho course of his employment. The question was answered affirmatively. Mr. Justice Hosking upheld an appeal by James A. Tocker against the decision of Mr. D. G. A. Cooper, S.M., in dismissing an information against Lucia Mercer, licensee of the Metropolitan Hotel, who was charged with selling liquor on a Sunday. The liquor had been sold by the assistant manager of tho hotel, and His Honour decided that the Magistrate was wrong in hold- , ing that there was not sufficient prima | facie proof tha}, tho assistant manager had authority to supply liquor on the. day in question. George Golcling appeared to receive sentenco for theft. His counsel, Mr. H. F. O'Lcary, requested that .he should not be sent to gaol, as ho was a first offender. Tho Chief Justice remanded him till to-day.
