Riddell, S.M., heard the civil cases in the Magistrate's Court yesThe'inspector of Awards (Mr. G. H. LightfootV proceeded against D. Itaran, an employee, to recover penalties m respect of breaches of the Wellington Dairymen's Employees' Award. It was alleged that Doran employed two boys to assist him in the delivery of milk, neither of the boys being an assistant employed by defendant's employers. Ihe defendant pleaded guilty to the offence, and was fined 10s.. and 3s. costs. T Noznle, of Kilbirnie, was charged that in the month of October he employed a boy and paid him Is. 6d. per day instead of -CI per week, The defendant was convicted and fined £1, with 3s. costs. The Inspector of Awards proceeded a°ainstCMrs. Parsons, proprietress of the Wentworth Private Hotel, to recover a penalty for a breach of the Wellington Private Hotel and Kestaurant Workers' Award. It was alleged that defendant, during.the month of October, employed a woman as a cook, and paid her only 275. 6d. per week instead of 30s. per week, as required by the award. After hearing the evidence the Magistrate gave judgment, for the defendant, for whom' Mr. A. W. Blair appeared. . The Inspector of Awards- proceeded against the Marble Bar, Limited, Manners Street, to recover a penalty for a breach of the Wellington Private Hotels and Restaurant Workers' Award. The breach alleged- was that the defendants, on September 30. and October I, employed a pantrymaid and paid her only 4s. per day instead of 7s. 6d., as required by ,the award. Mr. A. W. Blair.appeared for the defendant. After hearing the evidence the .Magistrate dismissed the case. A COMMON GAMING HOUSE. Mr. L. G. Eeid, S.M.. gave judgment in ,-the case of Robert Coleman, who was charged with keeping a common gamine house. The Magistrate reeofded a conviction and fined the accused £20, with costs. Morrison the sum of . .£l3 7s. 6d., on or before December 7, or serve M days,'imprisonment. CLAIM FOR DAMAGES. Mr. L. G. Reid, S.M.. heard further evidence in connection with the claim brought by Frederick G. Street, for whom Mr. P. W. • Jackson ' appeared, against the New Zealand ' Automatic Bakeries, Ltd., represented by Mr. T. W. Hislop. The plaintiff sought to recover £87 for damages alleged to have been sustained by reason of the defendant company through its servant having negligently and unskilfully, driven and managed a. delivery 1 ' van on the Hutt Road, near Kaiwarra. and causing same to collide with plaintiffs car, causing tho damage mentioned in the claim. After hearing the evidence the Magistrate reserved his decision. ' RESERVED JUDGMENT. Mr. W. G. Riddell, S.M., delivered reserved judgment in the civil action in which J. B. Clarkson and Co., Ltd., merchants, of Wellington, sought to recover the sum of i:76 Bs. lOd. from Samuel Aston, cycle agent, of Mangapapa. It was disclosed in the evidence that Aston purchnsed a business from one Walker, and took over .£7O worth of Walker's liabilities to tho plaintiff. For tho defence it was contended that plaintiff never relieved Walker, and that to succeed, plaintiff would have to prove a nova--tion. The Magistrate held tliat the correspondence proved a novation, and judgment was given for plaintiff for' ,£7O. The claim for .£6 Bs. lOd. for interest whs dismissed. Security for. appeal was fixed at- .£8 Ss. At the hearing Mr. H. E. Evans appeared for plaintiff, and Mr. E. M. Sladden for "defendant.
