Company, Ltd., to recover J!9SO 2s. Sd. for damage alleged to have been caused to a shipment of 1829 wises of bananas transhipped from the 's.s. Taluno at Auckland, and brought to Wellington in the s.s. Kamona. Mr. C. P. Skerrett, K.C.; with him Mr. It. Kennedy appoared for tho plaintiffs, and Mr. T. M. Wilford, with him Mr.' P. Levi,' represented-tho defendant company. The i6su.es submitted to the and the answers thereto were as follow: — ; (1) Was the steamship Kamona fit to carry the plaintiff's fruit from Auckland to Wellington? No.. (2) Was the plaintiff's fruit properly, stowed on tho said steamship?' No. (3) Was tho plaintiff's fruit injured in consequence of tho unfitness of the steamship to carry the same and of . improper stowage, and, if so, how many cases? 1372. ■ (4) What was the' price per case of luananas at Wellington on February 5? 12fs.- . His Honour reserved tlie matter for further consideration. : ' MOTOR ACCIDENT CASE. At the Supreme Court yesterday afternoon the hearing of the action brought by Hetty Tolly and another against Walter -Naismitli, commenced, before' the Chief Justice (Sir Robert Stout) and a jury of twelve was summoned. The claim was damages for injuries alleged to have been received in a motor accident, which occurred on September 12. Mr. A. L. Herdman, with him Mr.-. K. Kirkcaldie, Appeared for tho plaintiff, and the defendant was represented by Mr. T. Neave. _ The accident occurred while n motorcar was passing a tramcar on the Newtown line. .- The hearing of tho case for the rilaintiff was concluded last evening, "w'ioo tlio Court adjourned until 10 o'clock this : morning.
