PROTEST BY PUBLIC HEALTH MINISTER. , "

Yesterday the Mayor (Mr. J. p. Lute) received a further protest from the Minister of Public Health (the Hon. G W Russell) 011 the question of the milk'control by-laws recently adopted ;by the City Council. The protest (which, was forwarded- by telegraph) is as follows-.— "My attention has been called to a discussion in VVedliugton City Council on Thursday evening regarding" my decision re proposed city by-laws on milk supply. 11l my letter of May 8 I offered to appoint the City Milk Inspector an officer under the bale of foods and Drugs Act, thus arming liim with all the powers given in that statute. Instead .of accept-' Jug this offer, the City Council desires to re-enact as byrlaws some of the more important statutory provisions , already in existence in the Act.- This would lead to confusion, aj the Public Health Department and City Inspector would have • joint responsibilities. The City Council would also practioally assume control of the Government Analyst, which would create an impossible position. ■ The only object of the City's attitude appears to be to secure that all fines for breaches would go to the City funds, instead of to the State, as now required by law. On this point I distinctly offered to discuss with tho council an allotment of the Inspector's salary between the City and the Government, thus anticipating finahoial objection. Everything possible- within the law is being done to assist the council, but it is unreasonable to expect the Government to allow- tho council to assume functions already exercised under statute by a State Department. No public authority has ever previously asked for similar powers. If the council will accept my proposal that its Inspector should be appointed an officer under the Sale of Poods end Drugs Act, the difficulty will be solved. Kindly hand to Press."

Tho Minister's protest will come up for consideration at the next meeting of tho Public Health Committee pf the council.
