' OAN APPEAL Iu tho Supreme Court yesterday morning His Honour tho Chief Justice (Sir Robert Stout) heard an appeal from tlie decision of Mr. W. G. Biddell, S.JL, in .the civil caso of Eugeno Anton Schwarz r. Julian A. Lutz, both of Wellington. 'J'ho original claim in the Magistrate's Court was for JJI9O 15s. for commission, etc., allegod to lie due, and tho Magistrate gave judgment for tho plaintiff (Sclnvarz) for £78 15s.j and costs. Against this decision,; tho defendant (Lutz) appealed, on the gtxjund that it \ras erroneous in laiv. Mr. A. W. Blair appeared for the aopellant, ivliile Mr. P, W. Jackson appeared tor tho • respondent. After hearing afffument, His Honour reserved decision.

Sis' Honour Mr. Justice Edwards heard egal argument yesterday in tho case of l'rost v. the-l'aliuerston-North and ICailanga liiver Board, in which evidence had already been taken in Palmerston North. The question at issue was -as to whether a piece of land is portion of tho Manawatu llivor bed, or wnethcr it has become an accretion to the nropcrty of the plaintiff. Sir John Eindlay, K.C., ,with him Mr. D. li. Hogg.ird, annaared forltho plaintiff, while Mr. H. «. Cooper, of" Palmerston North, appeared for t'to defendant board. Docision was reserved.
