Mr. D. G. A. Cooper, S.M., presided lit yesterday's sitting < f tho Magistrate s Court, ivlien' the included tliree informations against Alexander Lindsay, alleging breaches of the Licensing Act. The defendant was on summons, and when his liaine was called he did not appear. The charges were therefore heaid in his absence, Inspector llendrey prosecuting. According to the evidence a tnan naineu Henry Moore recently informed the Mount Cook police that he had procured drink at a house occupied by Lindsay in \ avian Street,'and that while asleep in the place he li/id been robbed of his watchchain. iue police procured a search'warrant in to inspect the premises, and on their visit discovered a quantity of intoxicating liquor, wliich Lindsay was not licensed to sell. Neither was any -license held bv a civilian nnined Gorlmm, or a soldier named Thompson, who were found on the premises. Lindsay stated to the polico that tho liquor was the property of certain friends of his, but who these friends were was not apparent. THEFT. William Hughes appeared on remand for sontenco 011 two minor charges of theft. As ho had not previously been convicted of dishonesty, light lines (20s. ill each ease) were imposed. Tho alternative was seven days' imprisonment. Alfred John Hillier, who pleaded guiltj last week to the thoft of two garden ([•OK'ols, appeared 011 remand for sontonco At tho same tinio ho was further charged with tho theft of an alarm clock. To this charge lie entered a plea of not guilty, and was further remanded until this morning. INFORMATIONS DISMISSED. Hurry llincliolilf, who was employed to take tickets at Mr. j\shmead-Bartlett's lee. turo on Saturday night, was charged with tho theft of 25., tho property of Messrs. J. and N. 'J'ait. Mr. J?. W. .Tacltson ap peared for tho accused, who pleaded not guilty. Tho alleged theft consisted in the taking of 2s. from a soldier at 8.4.5 p.m in ! contravention of ofders that 110 ono should bo admitted withou.t a ticket. The defence was that the money was taken ill good faith, tho accused being under tho impression that the ticket ofiicc had closed, and having every intention of handing over the money to Messrs. Tait's treasurer,. Tho information was dismissed. , An information charging Henry Thomas Downes with assaulting Harry Mansell was dismissed, tho Magistrate being of opinion that tho assault was provoked by tho informant. Mr. T. M. Wilford appeared for Downes. , IMPROPER LANGUAGE. Harry Pliipps, who used obscene lan guage while drnnk, had several previous convictions against his naiiio. He was fined .£3, with the alternative of a month's imprisonment. - A soldier named Patrick James Cleary, who was also guilty of using obscene language while drunk, was fined -in default to undergo throe days' imprisonment. . . . Robert Henderson, who was charged with using obscene language, applied for and was granted a remand until this morning. Bail was allowed on easy terms. NOT WANTED. A member. of the crew of .the Celtio Qlen was arrested for drunkenness on Saturday, and was subsequently found to be stifforing from a disease, which was sufficient to make 'him an undesirable resident of this Dominion. His name was Martin Olson, and yesterday the Magis--trate sent Mm to gaol for too months for landing in Now Zealand in breach of the .statute. Should the. Celtic Glen leave, New Zealand before tho expiry of the sentence, Olsen will bo returned to tho vessol. . VAGRANCY. 51aj Gibbons, 32 years of age, pleaded not guilty to a charge of being an ineoi* risible rogue, but the evidence was held to bo against hot', and sho was sentenced to twelve months' imprisonment. On a charge of vagrancy, Arthur Moitis was convicted and ordered to qouio up for sentence when culled upon. .
MISCELLANEOUS.
Convictions for insobriety were recorded against the following:—Johann Gorzellick, fined J3, with the option of going to gaol for ono month; John M'Kinnon, fined dOs., or seven days' imprisonment; Thomas Reeves, fined 405., or se\en days' imprisonment; Archibald M'lntyro and John Flannigan,'fined 20s. each, or three days imprisonment; and several first offenders. Linda Catherine O'Connor, charged with insobriety, was_ remanded for a week for .curative treatnient. Frederick Edwards, wlio was los. in arrears with payments duo under a maih-
tonance order, .was sentenced to three days' imprisonment in' the Wanganui Gaol, but the sentence will not be enforced if tho money is paid forthwith. Ralph Stanley Lewis was Temanded to appenr at Elthain 011 a charge of theft of JMIO 135., ; the property of Herbert Henry iilake and Edward Charles White.
Alfred Musgrave, 76 years of ago, was convicted of attempting to commit suicide, and was ordered to come up for sentence
when culled upon.* Arrangements had Iweu made for his admission to Oliiro Home, but his daughter gave an under, taking to look alter him.
