Yesterday, in the Supreme Court, Mr. Justice Chapman concluded the bearing of tlio action in which the Crown claims £681118s. sd. estate duty fi'om the executors of Mrs. Jessie Begg, together with a statutory interest of £340, and less £209 14s. 9d.,' which had , been paid. The claim was made undei / the Death Ditties Act 1009. Mr. J ( W. Salmond, with whom was Mr. V. 'It. Meredith, represented the Crown, Sir John Fmdlay, K.C., was counsel for the defence, and Mr. D. 11. Hoggard appeared with him.I Decision was reserved. ' A BOROUGH'S OVERDRAFT. I Mr. Justice Hosking heard argument in a case between the Borough of Taurauga, plaintiff, and the Bank of New Zealand, and the Attorney-General, defendants. ' The Court was asked to decide : "Whether it is legally competent for . the plaintiff corporation to raise under - Section 16 of the Local Bodies' Loans Act, 1913, Paragraph A (that is by ; special order and without taking the , steps described in Sections Bto 12) a proposed loan of £4300 to repay out of such loau. the ovordraft of £2971 4s, 3(l.''and; otlier liabilities to the extent of £1336 ss. 10d., notwithstanding that such overdraft and liabilities were incurred after the commencement of the last-inontioaed Act. It iras stated that the money was needed for the installation of elect™ light, and that the amounts already , raised had-proved'insufficient. Mr. Martin, coitfisol for tho plaintiff, said that the argument would centre on the' meaning of the wprd "existing" .as it occurred in the section. Sir John Fiudlay, K.C., and Mr,_J. L. Stout appeared for the Bank of New ' Zealand, and Mr. J. W. Salmond, K.C., for the Attorney-General. Decison was .resolved.
