THE ARBITRATORS' AWARD
Tho arbitrators appointed under tho Mines Act to inquire into the condition of tho Taupiri Extended Mine (Messrs. 11. M'Ewan and, W. Loitch) found— (1) That no such dangero-.is or defective condition of the Taupiri Extended Colliery hafi been proved as will render necessary the additional outlet to tho surface from the said colliery required by tho said inspector in the said notice ; and that tho two existing Gbafts in tho Baid colliery are not inadequate and defective as means of egress under the conditions existing at tho said colliery. (2) Each party shall pay liis and its own costs of tho reference.
(3) Tho costs incidental to the appointment of the umpire shall he paid equally by tlio parties to the. arbitration.
To this award the arbitrators attached tlio following memorandum:—:
THE, WORKINGS UNDER THE LAKE.
. "After fully considering th© evidence adduced by tie parties in. this arbitration, and examining tlie workings, .we 1 desire to state that wo both agree that if hydraulic packing; is resorted to in that portion' of tlio old workings delineated by us, and being approximately in length about 25 chains, and in width about four chains, liamoly, about three chains outside the-margin of the lake, and one chain inside the n\argin of the lake, suoh packing will, wo consider, effectually seal up the workings under the lake, and prevent any danger of tho inundation of the mine from falls or subsidence in the under-lako workings. We suggest .tliat this course be adopted by tho company. NEW WORKINGS "UNDER THE RIVER. I "As to the workings under the river, after considering the evidence, mid having examined the workings under the river affccted by this inquiry, we are also agreed that this part of the workings is quito safo; but we suggest that i at. any part where a road is cut through a fault the same should be properly secured by iron girders and supports, as timber appears to soon decay and.become quite ineffective. An instance, of I this is to be found, in tho timber at the subsidence.
"We strongly urge upon the inspector and tho company tlio advisability of a conference between them for the purpose of discussing fully the suggestion we have made.
