NEW TRIAL TO TAKE PLACE.
Tho appeal was dismissal with costs oil the highest scalo in tho caso in which the appellant was John Wells Chapman, settler, of Wellington, tho respondent being Ramsay Macdougall, farmer, of Piriuoa. Mr. C. P. Skerrett, K.C., with him Mr. C. W. Tringham, appeared at the hearing for the appellant, while Mr. T. M. Wilford, with liirn Mr. W. Perry, appeared for tho resixmdont.
In the original action, Macdougall sued Chapman, to recover the sum of £3000 damages for alleged misrepresentation in regard to the sale of 1830 acres of land in the Waikata district. Tho jury's verdict was followed by a motion for judgment for tho defendant (Chapmaii), 'and judgment was entered accordingly. Counsol for tho plaintiff (Macdougall) next moved for a new trial on the ground that Chapman and his witnesses had made a mistako in.their evidence. After hearing argument on this motion. His Honour tho Chief Justice (Sir Robert Stout) ordered a new trial, and it was against this decision that tho defendant (Chapman) appealed, tho appeal as mentioned above-being dismissed.
