MAGISTRATE'S COURT

CIVIL BUSINESS SOME DEFENDED CASES Mr. W. G. Ttiddell, SMI, presided at the civil sittings of the Magistrate's Court yesterday. . Hearing of eases was adjourned in the morning until after the returned soldiers had landed. In the afternoon, His 'Worship heard the defended case in which the plaintiffs were Oliver Norman Mercer, hairdresser, of llataitai, and Daisy Lilian Mercer, his wife, while tho defendant was D. Kells, carrier, of Baden .Road, Kilbirnie. The plaintiffs claimed £20 from Kells in respect of a parrot, which was destroyed I'.V a dog owned by Kells. Mr. D. It. Boggard appeared lor the plaintiffs, while Mr. P. \Y. Jackson appeared for Kells. After hearing the evidence, the Magistrate gavo judgment for tho plaintiffs for £2 10s., and costs amounting to £3 17s.

Judgment was for plaintiff in the case of John Honry Hooper, land agent, of Wellington, v. J. J. R. Ewing, a claim for £200 for services rendered. The judgment was for the full amount, with £21 12s. costs. Mr. T. Young appeared for the plaintiff. Reserved judgmont was delivered in the case of Liery and Co., Ltd., v. Thomas Brierley, a claim for £36 damages for alleged breach of contract. Judgment was for the plaintiff company for the sum of £13, and costs £2 6s. UNDEFENDEDCLAIMS. Campbell, £5, costs £1 6s. 6d., against separate estate; L. G. Porter v. Garnet Holmes, £2 35., costs 10s. JUDGMENT SUMMONSES. Alfred Bradley was ordered to pay to George Sludge, the sum of £25 155., in monthly instalments of £2.

Phillip George was ordered to pay to Dr. C. C. Jenkins, tho sum of £4 Bs., on or before November 11, in default to undergo four days' imprisonment in Wellington Gaol. W. Collier was ordered to pay to T. Watt the sum of £11 Os. 6cl. on or before November 11, in default to undergo ten days' imprisonment in the Wellington Gaol. PRIVATE HOTELS' AWARD. In tlie case against Karantze Bros., for an alleged breach of the Private Hotel, Restaurant, and Oyster Saloon Workers' Award, a penalty of £1 was imposed. CLAIM FOR POSSESSION. In the case of David O'Hara v, William Gray Bailey, a ckini for possession and rent, the warrant for possession is to issue on November 11, the question of rent to be dealt with later. POLICE PROSECUTIONS.

Police cases were taken before Mr. I). G. A. Cooper, S.M. Bernard Charles M'Mahon and Walter Ross, two men appearing in uniform,, admitted having travelled on tlie steamer Mapourika from Groymoutli to Wellington without paying their faros._ They were remanded until this morning'for sentence. Ruby Kirk, alias Florence Prosser, was fined 40s. for using obsceno language. Tho alternative was 14 days' imprisonment.

For drunkenness, Noil Lamont was fined 205., with the option of three days' imprisonment. Similarly charged, Arthur Leonard was fined 10s.. the alternative in his case boing 48 hours' imprisonment. Four first offenders were dealt with.
