A RESERVED JUDGMENT

Mr. W. G. Riddell, S.M., presided at tho civil sittings of the Magistrate's Court yesterday morning, and delivered resorved judgment in tho caso of the jVew Zealand Express Co. v. Huddart Parker Proprietary Co., Ltd._ The claim was for '£21 Bs. Gd., being tho vaiue of goods (portion of a totalisator) shipped from Lytteltou to Napier, .ind not delivered by the defendant company. The Magistrate was of opinion that the weight of evidence *ent to show that the defendant! company did not deliver the package, and judgment was accordingly given for the plaintiff company for the amount claimed, with costs amounting to £10 18s. (id.

DEFENDED ACTIONS. Subsequently the Magistrate . heard the case of A. Searlc v. J. Scarlc, a claim for £158 Bs., alleged to be duo lor money lent and interest thereon. After evidcnco had been heard, judgment was given for the plaintiff (A. fiearle) for £I>lß 145., and costs £8 ss. fn tho case of Morison and Smith v. Oswald Ganlinor Hewison—also a defended action —judgment for tho plaintiffs for £1 lis. 6d., with Bs. costs.

POLICE CASES. The police prosecutions in the Magistrate's Court yesterday were taken before Mr. D. G. A. Copoer, S.M. Fritz Anton Struck, who had heen arrested 011 the arrival of the steamor Ulimaroa from Sydney on Monday, was charged with stealing unused official stamps to the value of £40. The allegation is that Stracls took the stamps while in the employ-of tho New Zealand Government, to whom the stamps belonged. Mr. T. M. Wilford appeared for the accused, who was remanded 011 bail (£80) until this morning. Thomas Frederick Dougall, a member of the crew of the Star of Australia was penalised to tho extent of 20s. and cost Ss. for assaulting the second cook on the steamor. Default was fixed at three days' imprisonment. Jean Dalziell, who had been found in an unoccupied house •in Frederick Street without lawful excuse, was convicted and ordered to come up for sentence when called upon. May Gibbons, charged with drunkenness, was sentenced to two months' imprisonment with hard labour. Justin Pratt, similarly charged, had not such a bad record as the previous accused, and he was given the choice of a fine of 20s. or a term of 48 hours' imprisonment. A first offender was convicted and discharged for drunkenness.

ALLEGED ASSAULT. • Further evidence was hoard in the cases arising out of a neighbours' quarrel at Rosenoath on September 30. Mrs. Eva Marie Meyer is prosecuting Mrs. Jeanne , Cliristensoii and Mrs. Bongo for assault, and there is a crossaction. Tho hearing commenced a fortnight ago, and the case was not concluded yesterday. It will be resumed at' a later date.
